Drafting ET3

Preparing your Tribunal Response

We will check that you do not have any outstanding case management orders that place you at risk of a strike out. We shall enter our names with the relevant tribunal office as your instructing representatives so all your tribunal correspondence is diverted directly to us.

Once on record, we shall assess any ET3 (Response Form) which has been submitted by you to check that all matters pleaded are stated in your response form. This is important since if you fail to fully defend against a claim raised by any employee, your company may be prejudiced and may be exposed to a substantial award in compensation.

If we feel your drafted ET3 would benefit from amendment, we shall apply to the Employment Tribunal to amend your pleadings and ensure that any claim is robustly defended.

We shall ensure all relevant witnesses are available to attend any pre-listed hearing dates and if you have a notice of hearing for a Final Hearing which clashes with an important date in your diary, we can seek to apply for a postponement of the hearing.

We shall ensure any outstanding case management orders are urgently addressed, preparing disclosure, inspection and agreed bundles of documents. We will meet with you to further understand your claims.

All relevant witnesses will be proofed and witness statements taken from the relevant witnesses. Before the final hearing, we shall explain the process and what you can anticipate on that day.
